How we operate legally

The Agriculture Improvement Act of 2018 (commonly known as the Farm Bill) removed hemp from the government’s list of controlled substances. Hemp is defined as cannabis with less than 0.3% Delta-9 THC by dry weight, officially distinguishing it from marijuana. All of our products comply with the Farm Bill, and are legally permitted to ship to most U.S. states.

Our products not only comply with Delta-9 THC content restrictions but also adhere to the stringent regulations outlined in the Farm Bill regarding hemp cultivation. This legislation mandates that licensed growers operate in accordance with state, tribal, or federal law. We conduct thorough testing and monitoring of our cannabis products to ensure they meet these regulatory requirements.
The majority of CheerGarden’s flowers, pre-rolls, and vapes utilize hemp-derived THCa. THCa is a non-psychoactive compound found in cannabis that, in its natural form, does not produce the intoxicating effects typically associated with Delta-9 THC. However, when smoked or heated, THCa converts directly into classic Delta-9 THC, resulting in a psychoactive high. THCa is a critical component in the compliance testing for hemp farmers, and we ensure that the farmers who produce our hemp-derived THCa meet all required standards to harvest their exceptional flowers. Once harvested, hemp is considered lawful as long as its Delta-9 THC content does not exceed 0.3%, a standard we strictly uphold. For products that aren’t heated during use — such as our edibles, gummies, and some concentrates — we typically use hemp-derived Delta-8 THC and/or Delta-9 THC, which are closely related to THCa. Both compounds are found in hemp: Delta-9 THC is known for providing the classic high associated with marijuana, while Delta-8 THC is often described as offering a milder, more clear-headed high with less paranoia. All of our products contain no more than 0.3% Delta-9 THC and are fully compliant with the Farm Bill.
While hemp-derived products are federally legal, state laws vary. Some states have lighter regulations, while others impose additional restrictions or outright bans on certain cannabis products.
